WAIVER AND RELEASE OF LIABILITY

The Mulberry House Short-Term Rental

I, [Guest's Full Name], hereby voluntarily rent and occupy The Mulberry House ("Property") located at 5004 Hemlock Street, Sacramento, California, for the duration of my stay. By renting and occupying the Property, I acknowledge and agree that my acceptance of the terms outlined in this "Waiver and Release of Liability" serves as a legally binding agreement. This means that, by renting and occupying the Property, I waive the requirement for a physical signature and still fully commit to the terms stated in this waiver. In consideration for being allowed to rent and occupy the Property, I agree to the following:

Assumption of Risk:

  • I understand that renting and occupying the Property involves certain physical activities and potential risks, including but not limited to the use of a hot tub, sauna, cold plunge, and cowboy pool.

  • I voluntarily assume all risks associated with my presence and occupancy of the Property, including but not limited to personal injury, illness, death, or property damage arising from the use of these amenities.

Release of Liability:

  • I hereby release, discharge, and hold harmless the owner(s) of the Property, their agents, representatives, employees, and affiliates from any and all claims, liabilities, actions, demands, expenses, or damages, including legal fees, arising out of my rental and occupancy of the Property, including but not limited to any injuries or accidents related to the use of the geodesic dome, hot tub, sauna, cold plunge, or cowboy pool, whether caused by the negligence of the owner(s) or otherwise.

Use of Amenities:

  • I acknowledge that the hot tub, sauna, cold plunge, and cowboy pool are provided as amenities for my enjoyment during my stay at the Property.

  • I agree to use these amenities responsibly and understand that failure to do so may result in injury or harm to myself or others. I agree to follow all safety guidelines and instructions provided for the proper use of these amenities.

Guests:

  • I understand that this waiver and release of liability also applies to any guests I invite over to the Property during my stay. I am responsible for ensuring that my guests are aware of and agree to the terms of this waiver.

Prohibited Events:

  • I agree not to host public or commercial events at the Property. The Property is intended for private stays and gatherings only.

Medical Fitness:

  • I represent that I am physically and mentally fit to use the hot tub, sauna, cold plunge, and cowboy pool. I understand that it is my responsibility to consult with a healthcare professional regarding any existing medical conditions or concerns that may affect my use of these amenities.

Indemnification:

  • I agree to indemnify and hold harmless the owner(s) of the Property, their agents, representatives, employees, and affiliates from any and all claims, liabilities, actions, demands, expenses, or damages, including legal fees, brought by any third party arising out of my rental and occupancy of the Property, including but not limited to my use of the hot tub, sauna, cold plunge, or cowboy pool.

Photography and Video:

  • I consent to the use of photographs or videos taken during my stay at the Property for promotional or other commercial purposes by the owner(s) of the Property, without compensation or further authorization.

Governing Law and Severability:

  • This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the State of California. If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

I have carefully read and fully understand the contents of this Waiver and Release of Liability, and I voluntarily agree to its terms. I understand that by accepting the terms of this document, I am giving up certain legal rights.
