WAIVER AND RELEASE OF LIABILITY

The Mulberry House Event

I, [Guest's Full Name], hereby acknowledge and agree to the terms outlined in this "Waiver and Release of Liability" as a condition for attending a gathering at The Mulberry House ("Event") at The Mulberry House ("Property") located at 5004 Hemlock street, Sacramento, California. By attending the Event, I waive the requirement for a physical signature and fully commit to the terms stated in this waiver. In consideration for being allowed to attend the Event, I agree to the following:

Assumption of Risk:

I understand that attending the Event involves certain physical activities and potential risks, including but not limited to the use of an inflatable water slide, sauna, cold plunge, hot tub, and cowboy pool. Additionally, I acknowledge the potential use of substances by myself or other attendees.

I voluntarily assume all risks associated with my presence at the Event, including but not limited to personal injury, illness, death, or property damage arising from the use of these amenities or the consumption of substances.

Release of Liability:

I hereby release, discharge, and hold harmless the owner(s) of the Property, their agents, representatives, employees, and affiliates from any and all claims, liabilities, actions, demands, expenses, or damages, including legal fees, arising out of my attendance at the Event, including but not limited to any injuries or accidents related to the use of the inflatable water slide, sauna, cold plunge, hot tub, cowboy pool, or any other amenities, whether caused by the negligence of the owner(s) or otherwise.

Use of Amenities:

I acknowledge that the inflatable water slide, sauna, cold plunge, hot tub, and cowboy pool are provided as amenities for my enjoyment during the Event.

I agree to use these amenities responsibly and understand that failure to do so may result in injury or harm to myself or others. I agree to follow all safety guidelines and instructions provided for the proper use of these amenities.

Guests:

I understand that this waiver and release of liability also applies to any guests I invite to the Event. I am responsible for ensuring that my guests are aware of and agree to the terms of this waiver. All guests are required to make a minimum donation of $33, which helps cover the costs of the party and all profits benefit the Rascal Foundation.

Medical Fitness:

I represent that I am physically and mentally fit to use the inflatable water slide, sauna, cold plunge, hot tub, and cowboy pool. I understand that it is my responsibility to consult with a healthcare professional regarding any existing medical conditions or concerns that may affect my use of these amenities.

Indemnification:

I agree to indemnify and hold harmless the owner(s) of the Property, their agents, representatives, employees, and affiliates from any and all claims, liabilities, actions, demands, expenses, or damages, including legal fees, brought by any third party arising out of my attendance at the Event, including but not limited to my use of the inflatable water slide, sauna, cold plunge, hot tub, or cowboy pool.

Photography and Video:

I consent to the use of photographs or videos taken during my attendance at the Event for promotional or other commercial purposes by the owner(s) of the Property, without compensation or further authorization.

Governing Law and Severability:

This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the State of California. If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

I have carefully read and fully understand the contents of this Waiver and Release of Liability, and I voluntarily agree to its terms. I understand that by accepting the terms of this document, I am giving up certain legal rights.
